VIK LEGAL law firm successfully defended the interests of an architectural studio in a commercial court dispute with a client who sought the refund of an allegedly unearned advance payment for 3D visualization of resort infrastructure facilities. The plaintiff claimed that the work was performed with material defects and in breach of deadlines, which, however, did not correspond to reality, as the original deadlines had been extended by agreement of the parties, and the work was accepted under an acceptance certificate without any objections. Our lawyers presented evidence of the plaintiff's bad faith, demonstrating that it had used the results of our client's creative work in an urban planning concept album for its own customer, which confirmed the commercial value of the delivered materials. The Arbitrazh (Commercial) Court of the City of Moscow upheld the defense's position and completely dismissed the claims.
