December 9, 2022 was marked by two victories in favour of our client – a large agricultural producer from India, which provides a significant share of Russian imports from this country.
On this day, our client received remittance from his buyer, one of the leading Russian distributors of fruits and vegetables, under an agreement on pre-trial settlement of debts for the supply of fresh grapes, which was reached and formalized the day before with the support of our lawyers. VIK LEGAL achieved a fast and efficient resolution of the dispute on favourable terms for the Indian company, which allowed it to receive its funds and avoid spending the time and resources that are usually associated with conducting litigation.
Also on this day, the Arbitrazh (commercial) court of Moscow granted in full the company's claim for the recovery of funds for the grape delivered from another Russian buyer. Objecting to the claims, the defendant put forward arguments that the goods allegedly had inadequate quality, and referred to the survey reports. The court totally rejected these arguments, agreeing with our position that the reports deserve critical assessment and cannot be accepted as reliable, admissible and relevant evidence.
